ADA Can't Wheel Over Seniority Policy!

ADA does not override a nondiscriminatory seniority policy according to the 4th Circuit Court of Appeals. The Court has determined that company nondiscriminatory seniority systems are policies to which an employer can defer and that the Americans with Disabilities Act (ADA) does not require employers to deviate from such policies to accommodate disabled employees.
