Hourly Pay On Family Leave Does Not Change For Overtime-Exempts

Hourly pay during FMLA leave does not affect employee's overtime-exempt status: The 9th District Court of Appeals has held that a salaried supervisory employee who was paid on an hourly basis during a medical leave covered by the FMLA remained exempt from overtime compensation requirements of the Fair Labor Standards Act.
