Can you fire an employee who fails to produce the required document(s) of eligibility and identity on or before the first day of employment?

No. The employee has three business days to produce the document(s). You can terminate the employee who fails to produce the required document(s) or receipt(s) for replacement document(s) within three business days from the date employment begins. Employees presenting a receipt for replacement document(s) must, within three business days, produce receipt(s) showing a request for replacement document(s) and present the actual ducument(s) within 90 days from the date employment begins.
