This federal judge clarifies proof needed for age discrimination!
In a discrimination case, simply casting doubt upon an employer's stated
reason for denying a promotion to an older worker is not enough to win. This
is if the decision maker testifies credibly that age had nothing to do with the
decision, or so a federal judge in Philadelphia ruled. The plaintiff, was
denied a Postal Service promotion, succeeded in discrediting the reason given, but
couldn't prove age discrimination was the real reason.
