Judge rules looking at old e-mails not wiretap violation
An employer's decision to dig through an employee's e-mails in
computer storage does not violate any federal or state wiretap laws
-- not even the "Stored Communications Act"-since the laws are
triggered only when the interception occurs "in the course of
transmission," a federal judge has ruled. The judge said reading
old e-mails may be ethically questionable, but it isn't legally
